With reference to Foreign Office letter No. F6891/2906/10 of the 13th July 1939, I am directed by Viscount Halifax to enclose a copy of a despatch from His Majesty's Ambassador at Tokyo, together with a note from the Japanese Ministry of Foreign Affairs and of the reply which Sir Robert Craigie proposes to send, regarding the outcome of the action against the Cheng Kee Company in the Hong Kong Courts.
2. Subject to any observations which Mr. Secretary MacDonald may have to offer, Lord Halifax proposes to inform His Majesty's Ambassador by telegraph that he concurs in the terms of his proposed reply, provided the Governor of Hong Kong concurs in the statement that further legal remedies are still open to the Japanese interests concerned.

A copy of this letter is being sent to the Board of Trade for information.
